About This Event
The Lenders' Handbook - A Guide to Professional Duties for Conveyancers is an engaging virtual classroom seminar designed for residential conveyancers involved in lending processes. This online event aims to address the critical issues that conveyancers must navigate while representing lenders, particularly concerning the concerns over rent charges and remedies as defined under section 121 of the Law of Property Act (LPA) 1925. Participants will explore practical lessons derived from key negligence cases against conveyancers brought forth by lenders, thereby enhancing their understanding of the legal landscape in which they operate. The seminar will delve into several important topics, including the significance of a brief ownership period from a lender's viewpoint, as well as strategies to safeguard lenders against the risk of mortgage fraud. Attendees will learn the importance of adhering to the Law Society's Code for Completion from the seller's conveyancer's perspective, as well as the conditions under which a lender may refuse to accept a flying freehold, even if an indemnity policy is in place. Additionally, the session will cover necessary investigative measures regarding suspected breaches of planning and building regulations, the implications of discrepancies in purchase prices, and the reporting requirements that follow. Other key discussions will include the terms of NHBC cover for new builds, the acceptability of architect's certificates, and the relevance of section 106 agreements in relation to the Community Infrastructure Levy. Moreover, participants will be guided on how to handle building works that violate restrictive covenants and the reasonable inquiries to make in such situations. As part of the comprehensive coverage, the seminar will also address the lender's right to request a borrower's file and the implications of bankruptcy entries and undervalue transfers. Lastly, a Landlord Certificate will be required for relevant buildings, ensuring all attendees leave with a thorough understanding of the expectations and responsibilities outlined in the Handbook. Following the live session, participants will have the opportunity to revisit the material through an accessible recording, allowing for further reflection and learning.
